General Conditions

 TERMS & CONDITIONS 

Please read these Terms & Conditions of Service carefully as they constitute a legal agreement of terms and conditions between you, as the user of our products and services, and the company ANDES PERU VOYAGES.

 

These terms apply to all reservations through this website, directly via email or Whatsapp, officially published on our website “Contact” section. After making a deposit and/or bank transfer, you accept and acknowledge that you have read, understood and agree to these Terms. If you make a reservation on behalf of other participants, you guarantee that you have the authority and power to accept these Terms over the other participants for whom you make the reservation. Please note that travel arrangements are not confirmed until stated so in writing by ANDES PERU VOYAGES.

 

Payment / Deposit

In order to secure a booking with ANDES PERU VOYAGES, the client must deposit 50% of the total tour cost at the moment of the booking. This deposit is non-refundable in case of cancellation by the client until 30 days before the start of the program. The balance of the program must be paid in cash on the first day of the passenger's arrival in Cusco.

 

Payment must be made to ANDES PERU VOYAGES in Cusco / Peru. All commissions, taxes and transfer costs of the different means of payment (Credit or debit card, PayPal, Bank, etc) will be at the customer’s expense, they will not be at the expense of ANDES PERU VOYAGES. In the case of banks, the client should inquire about all transfer costs: bank of origin costs + intermediate bank costs + Peruvian bank costs.

 

In the event that the payment or deposit is made by a third person outside the group, a copy of the passport or the identity document of said person must be sent.

 

Cancellation by Us

ANDES PERU VOYAGES reserves the right to cancel a program in case any of the following circumstances occur:

1.- Client’s failure to pay the due balance according to the established deadline, that is the day of the arrival of the passenger to the city of Cusco, before the start of the program. In this case, the client will not have any right for the deposit refund.

2.- Force majeure: Impossibility to operate the program due to unusual or unforeseen circumstances outside ANDES PERU VOYAGES’s control. These may include but are not limited to delays in departures, flights and/or travel arrangements caused by technical problems, weather conditions, over-booking or closure of a hotel, strikes, riots, decisions by State Governments or Tourist Organizations altering the itinerary, the duration of the time spent in a city or even omitting a city or part of the itinerary due to the local situation. In such cases, ANDES PERU VOYAGES will propose viable solutions to operate the program or comparable travel arrangements. If any of the circumstances listed above occur during the course of the tour, we reserve the right to alter the scheduled itinerary accordingly and no compensation will be paid. We will make every reasonable effort to provide you with the booked program arrangements but changes may occur. If they are significant, we shall, if possible, inform you before the departure date. Again, we will offer comparable alternative arrangements. All additional expenses derived will be at the expense of the client. Please note that ANDES PERU VOYAGES will not be liable to reimburse additional expenses undertaken by the client in preparation for the tour, this including international tickets, used mileage awards and fees, cost of visas, immunizations, shots, among others. 

Alterations by You

If the client requests any amendments to the initial travel arrangements once a booking is confirmed, ANDES PERU VOYAGES will do its best to implement them, but we cannot guarantee that it will be possible. In the event of such an amendment being made, the client will assume all costs and penalties that may arise from modifying the original reservation. 

Cancellation by You

In case of cancellation by the client, this should be notified to ANDES PERU VOYAGES in writing. Please note that the program deposit is non-refundable. Such notification will only be deemed to have been given on receipt of your letter or e-mail, since we can only act on receipt. Please state the reason for cancellation as you may be covered by your insurance policy.

If cancellation notice is received 30 days or less before the program start date, the client will forfeit their entire deposit. If cancellation notice is received 31 days or more before the program start date, penalties, taxes, and fees incurred will be calculated. If any balance remains, ANDES PERU VOYAGES will refund passengers, less shipping costs.

Refunds or returns do not apply to air tickets (national or international) in case these have been included in the price of the tour package. Any refund will apply only to the tours.

Cancellations received on weekends (saturday and sunday) or holidays, will not be considered as the day of cancellation of the program, will be considered the first business day of the following week. We cannot give any allowance or refund for meals, rooms, excursions, etc. not taken, when these are included in the price of the tour. No refund can be made on lost, mislaid or destroyed travel tickets or vouchers. There will be no refunds made for cancelled or unused services whatsoever.

Prices and Surcharges

The program price per person in US$ is based on the number of participants agreed at the moment of the booking confirmation and is therefore only valid for this number of guests. Should the number of guests decrease, the total program price per person would increase and, equally, an increase in the number of guests may lead to a decrease in the program price per person.

Travel Insurance

ANDES PERU VOYAGES strongly recommend that you take out a travel insurance covering accidents, medical care, emergency evacuation, lost or stolen luggage, trip cancellation or interruption, and repatriation. This insurance must be purchased prior to the start of the tour and is the sole responsibility of the guest. 

Our transport units have coverage of SOAT (Mandatory Traffic Accident Insurance) valid in all company vehicles. This insurance covers just emergency medical expenses and immediate assistance in the event of an accident during official ground transportation for the tour.

In the event of incidents occurring outside the vehicle, such as illness, personal accidents, lost belongings, or situations beyond the control of our transportation services, the client assumes full responsibility. Therefore, it is strongly recommended to purchase international travel insurance that provides full coverage throughout your stay in Perú.

ANDES PERU VOYAGES will collaborate at all times with care, transportation, contact with clinics, medical reports, and any emergency management necessary to safeguard the traveler. 

Authority of the guide

During the tour, the guide has full authority to make decisions for the safety of the group. Failure to comply with legal or group rules may result in expulsion without a refund.

Limitation of liability

ANDES PERU VOYAGES do not own, operate, control, supervise or manage any of the suppliers of transportation, land operators, accommodations, food and goods, and related travel services provided to the tour participant. As such, ANDES PERU VOYAGES is not liable for any injury, damage, loss, inconvenience, irregularity, or delay resulting, directly or indirectly, from acts of God, detention, quarantines, civil disturbance, criminal activity, government regulations, etc. over which it has no control.

ANDES PERU VOYAGES directly operates part of the services included in a program but also makes arrangements with airlines, hotels and other independent parties to provide you with the travel services you purchase. We do take all reasonable steps to ensure that organizations providing services maintain our quality standards. However, these parties are independent suppliers over whom we have no direct full control.

When you travel with an airline, the conditions of carriage of that airline will apply. These conditions are the subject of international agreements and may limit or exclude liability. ANDES PERU VOYAGES is not liable for any expenses or consequences resulting from flight delays, cancellations or missed connections, and such expenses shall be borne by the client.

Travel Documents

It is the responsibility of the individual traveler to secure the proper documentation prior to joining the program. The client must be in possession of a valid passport with at least six-month validity after the end date of their tours and all visas required for the whole of the journey. Those traveling with minors should contact their international airline for requirements. Minors under the age of 18 must be accompanied by a parent, guardian, or adult relative with the appropriate documentation.

Please note: We will use the passport information you provide on your booking form to book entry tickets, hotels, flights, and the Inca Trail (if applicable). If you change or renew your passport, be sure to bring both your old and new passports with you.

Claims and Complaints

If a client has a complaint against the company the client must first inform the tour conductor, guide or company representative while on the tour in order that the guide/representative can attempt to rectify the matter. Any further complaint must be put in writing to the company within 7 days of the end of the tour.

Venue for all claims or disputes shall be exclusively in Cusco, Perú, whose courts, using Peruvian Law, shall have exclusive jurisdiction. Damage claims against ANDES PERU VOYAGES shall be limited to the value of the particular item in dispute. Any liability is limited to the full price paid for the tour. In all cases the company specifically excludes all liability for indirect, incidental or consequential loss or expense including loss of profits.

ANDES PERU VOYAGES assumes responsibility for representations it makes, but not for those made by others and including, but not limited to, any employee of ANDES PERU VOYAGES or any independent travel agent. 

Payment for reservations on any ANDES PERU VOYAGES program or tour shall constitute consent to all the provisions in the Booking Terms & Conditions set out herein and is binding on all tour and travel participants.

Generally, we collect your information through a form on our website or during the trip booking process. We will always try to collect data by legal and correct means. In addition, it will be with the knowledge and consent of the affected person(s).

Our website also uses "cookies" to offer you a better browsing experience and so we can better understand what type of travel you enjoy.

Security

We take precautions when protecting your information. When you send sensitive information through the website, it will be secure both online and offline.

Whenever we collect important information (such as credit card data), it is encrypted and transmitted securely. You can verify this by looking for a closed padlock icon at the bottom of your web browser or by looking for "https" at the beginning of the web page address.

Although we use encryption to protect sensitive information transmitted online, we also protect it offline. Only collaborators who require the data to perform a specific job (billing or customer service) will have access to personally identifiable information.
